HUSSEY TERMINAL RAILROAD COMPANY—ACQUISITION AND OPERATION EXEMPTION—2ND & MAIN, LLC
Decided: March 23, 2017
On February 16, 2017, Hussey Terminal Railroad Company (HTRC), a noncarrier, filed a verified notice of exemption under 49 C.F.R. § 1150.31 to acquire from 2nd & Main, LLC (2ML) and to operate approximately 540 feet of rail line in North Chicago, in Lake County, Ill. (the Line). HTRC supplemented its verified notice on February 24, 2017.
HTRC’s notice of exemption is contingent upon the effectiveness of a related notice of exemption in 2nd & Main, LLC—Acquisition & Operation Exemption—Norland North Chicago, LLC, Docket No. FD 36106, in which 2ML seeks Board authority for its 2014 acquisition of the Line. That related notice was served and published in the Federal Register on March 22, 2017 (82 Fed. Reg. 14,787), and is scheduled to become effective on April 5, 2017.
Because the 2ML acquisition exemption in Docket No. FD 36106 must become effective before HTRC can complete its own acquisition from 2ML of the Line in this docket, the publication of the notice in this docket, Docket No. FD 36103, and its effective date will be held in abeyance pending further order of the Board.
It is ordered:
1. The publication of HTRC’s notice of exemption in this docket and its effective date are held in abeyance pending further order of the Board.
2. This decision is effective on its date of service.
