THE ATLANTA DEVELOPMENT AUTHORITY D/B/A INVEST ATLANTA AND ATLANTA BELTLINE, INC.—VERIFIED PETITION FOR A DECLARATORY ORDER

This decision grants a joint request by The Atlanta Development Authority d/b/a Invest Atlanta (Authority), Atlanta BeltLine, Inc. (ABI), and Norfolk Southern Railway Company (NSR) to extend time to file documents in this proceeding.

 

By decision served on December 15, 2016, the Board found that the Authority and its predecessors in interest acquired certain real estate underlying a line of railroad in Fulton County, Ga., for which they should have first obtained acquisition authority from the Board.  The Board ordered the Authority to either obtain Board authority or amend the deed under which it acquired the real estate, within 30 days of the December 15, 2016 decision.  

 

On January 13, 2017, the Authority, ABI, and NSR filed a joint request for an extension of 30 days to respond to the Board’s directive.  They express the intent to amend the deed in question, but assert that, due to the year-end holidays, the requisite personnel were unable to finalize and record the amended deed in the allotted time.  The request for an extension of 30 days is reasonable and will be granted.

 

It is ordered:

 

1.  The Authority must file the required documents by February 16, 2017.

 

2.  This decision is effective on its date of service.
