SOO LINE RAILROAD COMPANY—PETITION FOR DECLARATORY ORDER AND PRELIMINARY INJUNCTION—INTERCHANGE WITH CANADIAN NATIONAL

 

Decided: June 7, 2019

 

On April 30, 2019, Soo Line Railroad Company d/b/a Canadian Pacific (CP) filed a petition for declaratory order and preliminary injunction arising from the termination of an interchange agreement with Wisconsin Central Ltd. d/b/a Canadian National (CN) in the Chicago Terminal Area. CP states that the agreement provides for all interchange of CN and CP rail cars in Chicago, Ill., at Spaulding, where the two railroads physically connect. (CP Pet. 1.) By decision served on May 9, 2019, the Board directed CN and CP to participate in Board-sponsored mediation.

 

Because of the significant public interest in this proceeding and in the interest of a complete record that embodies the full spectrum of interests involved, the service requirements of 49 C.F.R.  1104.12(a), which require every document filed with the Board to be served upon all parties to the proceeding, will be waived for individual private citizens who wish to file comments regarding this proceeding. Thus, submissions made by individual private citizens will be added to the docket in this proceeding following this decision, regardless of whether the submissions comply with the service requirements of 49 C.F.R.  1104.12(a). All others must comply with the Board’s service requirements and serve comments on all parties of record listed on the Board’s service list for this proceeding.

It is ordered:

 

1. The service requirements in this proceeding are modified as discussed above.

 

2. Submissions by individual private citizens received by the Board as of the service date of this decision are accepted into the record.

 

3. This decision is effective on the date of service.
