This decision makes, pursuant to 49 C.F.R. § 1011.7(a)(2)(ix), a Finding of No Significant Impact under 49 C.F.R. § 1105.10(g).
Morristown & Erie Railway, Inc. (M&E) filed a verified notice of exemption under 49 C.F.R. pt. 1152 subpart F—Exempt Abandonments to abandon less than one mile of rail line consisting of 490,140 square feet located on the westerly side of Harrison Avenue, part of Block 12, between milepost 9 and the end of the line at Harrison Avenue in the Borough of Roseland, Essex County, N.J. (the Line). Notice of the exemption was served and published in the Federal Register on August 3, 2016 (81 Fed. Reg. 51,265). The exemption is scheduled to become effective on September 2, 2016.
The Board’s Office of Environmental Analysis (OEA) served an environmental assessment (EA) on August 8, 2016, solicited comments, and issued a Final EA on August 26, 2016. No environmental or historic preservation issues were raised by any party or identified by OEA. Accordingly, a Finding of No Significant Impact under 49 C.F.R. § 1105.10(g) will be made pursuant to 49 C.F.R. § 1011.7(a)(2)(ix).
It is ordered:
1. Abandonment of the Line will have no significant effect on the quality of the human environment and conservation of energy resources or on historic resources.
2. This decision is effective on its service date.
