PAULSBORO REFINING COMPANY LLC—ADVERSE ABANDONMENT—IN GLOUCESTER COUNTY, N.J.

 

Digest:[1]  The Board grants a joint petition from Paulsboro Refining Company, LLC (PRC) and SMS Rail Service, Inc. to dismiss PRC’s adverse abandonment application, vacate the Board’s resulting December 2, 2014 decision, and terminate the proceeding. 

 

Decided:  June 18, 2015

 

            On May 27, 2015, Paulsboro Refining Company, LLC (PRC) and SMS Rail Services, Inc. (SMS) filed a joint petition requesting that the Board dismiss PRC’s adverse abandonment application, vacate the resulting December 2, 2014 decision on that application,[2] and terminate the proceeding.  The petitioners explain that they have agreed to settle their differences underlying this proceeding.  On June 12, 2015, Consolidated Rail Corporation, Norfolk Southern Railway Company, and CSX Transportation, Inc., submitted a joint response in which they do not object to the petition.

           

            The joint petition will be granted. 

 

This action will not significantly affect the quality of the human environment or the conservation of energy resources.

 

It is ordered:

 

1.  The joint petition to dismiss PRC’s application, vacate the December Decision, and dismiss the proceeding is granted.

 

 

 

 

2.  This decision is effective on the date of service.
