Small Business Compliance

The Regulatory Flexibility Act (RFA) and related laws and executive orders require federal agencies to consider the effects of regulations on small entities.  The Small Business Regulatory Enforcement Fairness Act of 1996 (SBREFA) amended the RFA and provided additional tools to aid small businesses.  Pursuant to Section 212 of the SBREFA, agencies are required to prepare and publish guides to assist small entities in complying with final rules.  However, if the agency certifies that a rule will not have a significant economic impact on a substantial number of small entities, the agency is not required to issue a small entity compliance guide.  The following are compliance guides that the Board has issued in recent years.  More information on compliance guides and the requirements of the RFA and SBREFA in general are available here.
