The Surface Transportation Board today instituted a proceeding on the application filed by the National Passenger Railroad Corporation (Amtrak) under 49 U.S.C. § 24308(e), which seeks an STB order requiring CSX Transportation, Inc. (CSXT), and Norfolk Southern Railway Company (NSR) to allow Amtrak to operate additional intercity passenger trains over their lines along the Gulf Coast between New Orleans, La., and Mobile, Ala.
In addition to instituting a proceeding, the decision also denies a motion to dismiss filed by CSXT and NSR, denies as moot a request for an interim order regarding track access by Amtrak, establishes a procedural schedule, and appoints an administrative law judge to resolve initially all discovery disputes.
