STB Issues Procedural Schedule in Amtrak’s Application for Use of CN Facilities

The Surface Transportation Board today issued a decision adopting a procedural schedule regarding the National Railroad Passenger Corporation’s (Amtrak) application, asking the Board to establish reasonable terms and compensation for Amtrak’s use of Canadian National Railway Company’s (CN) facilities and services.

On August 9, 2019, the Board issued interim findings and guidance and initiated Board-sponsored mediation to facilitate further negotiation between the parties.  The mediation period was extended, and on January 22, 2020, mediation between the parties ended without settlement.  On January 25, 2022, Amtrak and CN filed a joint motion to establish a procedural schedule.

Today’s decision grants the joint request to establish a procedural schedule but shortens the time requested, considering the extensive record already developed.  Opening submissions are due on May 2, 2022.  Reply submissions are due on July 1, 2022.  Rebuttal submissions are due on August 1, 2022.
